Terms of Service
Plain-language terms for using Tactova. Please read them — they matter.
1. Acceptance
By accessing or using Tactova (“the Service”) you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to all users including free trial accounts.
2. Description of the Service
Tactova provides AI-assisted competitive intelligence for Amazon sellers. The Service retrieves publicly available Amazon product data via third-party APIs, processes it to estimate market conditions, and generates strategy recommendations using large language models.
All data presented is derived from public sources. Tactova does not guarantee the accuracy of third-party data, Amazon rankings, pricing, or review counts.
3. Accounts
3.1 Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organisation.
3.2 Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at security@tactova.com if you suspect unauthorised access.
3.3 One account per person
Each account is for one individual or organisation. You may not share login credentials or create multiple accounts to circumvent credit limits.
4. Credits and caching
4.1 Credit consumption
Each new analysis run consumes one credit. A “new run” is defined as an analysis of an ASIN + marketplace combination where no valid cached result exists.
4.2 Caching
Analysis results are cached for 30 calendar days from the run date. Retrieving a cached result does not consume credits. The cache is per-user — you only benefit from your own prior runs.
4.3 Credit expiry
Monthly subscription credits do not roll over unless your plan explicitly states otherwise. Top-up credit packs purchased separately do not expire for 12 months from purchase.
4.4 No refunds for consumed credits
Credits consumed by completed analysis runs are non-refundable. If a run fails due to a Tactova service error, the credit will be restored automatically.
5. Payments and billing
- Subscriptions are billed monthly or annually in advance.
- All prices are in USD and exclude applicable taxes.
- Payments are processed by Stripe. Your card is charged on the same date each cycle.
- You may cancel your subscription at any time from account settings. Access continues until the end of the paid period.
- Downgrading mid-cycle does not result in a prorated refund for the current period.
- We reserve the right to change pricing with 30 days notice to active subscribers.
6. Free trial
New accounts receive a 7-day free trial with a limited credit allocation. No credit card is required to start a trial. At the end of the trial, the account reverts to a free tier unless you subscribe. Trial credits cannot be extended or transferred.
7. Acceptable use
You agree not to:
- Use the Service to scrape, bulk-export, or redistribute Amazon data in violation of Amazon's terms
- Reverse-engineer, decompile, or attempt to extract the underlying AI models or algorithms
- Use automated scripts or bots to consume credits at a rate that impairs the Service for others
- Resell, sublicense, or white-label the Service without written permission
- Use the Service for any unlawful purpose or in a way that violates third-party rights
- Attempt to access accounts, systems, or data that you are not authorised to access
8. Intellectual property
The Tactova platform, brand, and proprietary algorithms are owned by Tactova, Inc. You retain ownership of the ASIN inputs you provide. Analysis outputs generated from your inputs are licensed to you for personal and commercial use. You may not publish, sell, or redistribute raw output in a way that competes with Tactova.
9. Data and privacy
Our collection and use of personal data is described in the Privacy Policy, which forms part of these Terms.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose or merchantability. Tactova does not warrant that:
- Analysis results will be accurate, complete, or up to date at any given moment
- AI-generated recommendations will result in profitable outcomes
- The Service will be uninterrupted or error-free
- Amazon marketplace data retrieved through third-party APIs will reflect real-time conditions
11. Limitation of liability
To the fullest extent permitted by law, Tactova's total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid to Tactova in the 3 months preceding the claim.
Tactova is not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, even if advised of the possibility of such damages.
12. Indemnification
You agree to indemnify and hold harmless Tactova and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
Tactova may suspend or terminate your account at any time if you violate these Terms, with or without notice. Upon termination, your access to the Service ceases and unused credits are forfeited unless termination is due to our breach.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law provisions. Any disputes shall be resolved by binding arbitration in Delaware, except that either party may seek injunctive relief in a court of competent jurisdiction.
15. Changes to these Terms
We will provide at least 14 days notice of material changes via email. Continued use of the Service after the effective date constitutes acceptance. If you do not agree to the updated Terms, you may cancel your account before the effective date.
